Develop movement to challenge the runaway judiciary and elected officials who surrender their Constitutional prerogatives (and an often complacent public that would rather have the Supreme Court decide than fight it out amongst themselves) by building support for Constitutional amendments. Such amendments would first of all be “negative”–that is, they would remove various questions from the authority of judges.
We could start with easier cases, where the Supreme Court has removed from public debate issues on which a substantial majority of Americans would disagree with the decision if they could vote on it, and then move on to closer calls–like, for example, limiting the Court’s authority in determining what kinds of evidence lower courts must throw out.
Significant change could actually be made this way, but over and beyond the actual amendments and their implementation, this would be a very educational and participatory project, involving debates over crafting the precise language, gathering grass roots support, asking each and every candidate where they stand on the proposed amendment, generating news stories by finding ways to dramatize the difference the amendment would make, and so on.
